Bango sounds a little dumb, but maybe they know they are
being dumb, and have little choice - I've known startups
to not get funding because they wouldn't describe any
of their innovations as "patent pending," at least.  Even
when they actually had innovations arguably worthy of
patenting.

Note also that public whomping on companies for software/web
patents is all out of proportion to the actual abuse - compare
PriceLine's dozens of web patents to Amazon's mere handful.
But who gets lined up against the wall and pumped full of
lead by the web/software community?  Amazon.  Why?
Because all the open-source software books we've ordered
from Amazon (at an average of $5 loss each, for Amazon) has
raised their profile far above PriceLine's in our eyes.

Please also note that organizations like the USPTO are not
there to certify the validity of patents per se, but rather to
make sure they pass some basic filing tests.  The only real
test of a patent is in a successful defense.  Blaming patent
offices for all stupid patents is like blaming traffic cops for
all stupid drivers.
